TB serves Derek Draper

It wasn't just McBride that was served this morning, Tory Bear went along to pay his old friend Dolly a visit. Sadly Derek was out, but he handed the court papers on behalf of Nadine Dorries MP, to Mrs Draper, whose smile faded somewhat when TB explained who the letter was from...



Love the smell of justice in the morning...

Good stuff! Will be interesting to see how they try to wriggle out of it now - and it'll be good fun if the preliminaries take place as Gordon takes to the podium in Brighton...

Pantomime. Nadine effectively smeared herself. Noone would have known she was mentioned unless she had outed herself. What on earth is the complaint going to be here? And the "damage"? Prediction: all gets dropped or if not Nadine ends up paying everyone's costs.

Post Common Purpose - depends whether this was a letter before action, or the actual claim form (TB, can you clarify?)

If the former, then the solicitors writing the letter specify a deadline for apologising and coughing up, or else court action follows.

If it's the claim form itself, they have 14 days to acknowledge service or contest jurisdiction (Form N9) and then 14 days after acknowledgement to either admit the claim or file a defence.

Sadly, service on a spouse doesn't count. You'll need to get a concurrent summons and post it or hand it to him.

"Personal service" on an individual requires leaving the summons with THAT person.

Service by first class post is an "alternative" to personal service.

A second class stamp or putting it through the letter box ain't enough - its an old bar exam question!

He may waive the point although there may be some liability in costs for not doing it right.

I know this was the case in the good old days pre Woolfe's reforms, but surely the rules have changed? I can't imagine Dorrie's lawyers letting someone serve a claim without explaining how it must be done!

CPR Part 6.3
A claim form may be served by personal service in accordance with rule 6.5 or first class post, at a document exchange.

The provision for service by leaving it at a permitted place doesn't apply.

There's no "leaving it at the home address" or with a spouse exception nor any notion that a spouse is an agent for the purpose of service.

Guide and Tory Bear both refer to "serving" official court papers but the Grauniad is reporting that this was just a letter of claim. There is is a big difference.
